Terms of Engagement
1. Definitions
1.1.
“0800tulips” means a brand & trademark, which may be used by our agents or sister company or our authorised brand users or employees thereof.
1.2.
“Customer” shall mean the customer, any person acting on behalf of and with the authority of the customer, or any person purchasing products or services from us.
2. Acceptance
2.1.
Any instructions received by 0800tulips, oral or written, email or website, from the customer for the supply of goods or services or both shall constitute a binding contract.
3. Price and Payment
3.1.
Prices given over the phone or in writing, without physical inspection are an indicative price/ estimate & are subject to change.
3.2.
Payment for Goods and Services shall be made in full on or before completion. Account holder clients may settle their account within ten days from completion or as agreed with the management.
3.3.
Interest may be charged on any amount owing after the due date at the rate of 5% per month or part month thereof.
3.4.
Any expenses, disbursements and legal costs incurred by 0800tulips in the enforcement of any rights contained in this contract shall be paid by the customer, including any reasonable solicitor’s fees or debt collection agency fee.
3.5.
Receipt of a cheque, Bill of Exchange or other negotiable instrument shall not constitute payment until such negotiable instrument is paid in full.
4. Quotation / Estimate
4.1.
Where a quotation is given by 0800tulips for Goods and Services:
4.1.1
Unless otherwise agreed the quotation shall be valid for thirty (30) days from the date of issue; and
4.1.2
The quotation shall be exclusive of Goods & Service tax unless specifically stated to the contrary;
4.1.3
0800tulips reserves the right to alter the quotation because of circumstances beyond its control or if the assement by the technician contradicts the information received from the client.
5. Risk
5.1.
The time agreed for delivery of Goods or Services shall not be an essential term of this contract unless the customer gives written notice to 0800tulips making time of the essence.
6. Materials Warranty
6.1.
0800tulips guarantees to supply only high quality materials & services.
6.2.
0800tulips shall remedy or repair faulty workmanship where it is satisfied that the fault has not been caused by factors beyond its control at no extra charge .
7. Workmanship Warranty
7.1.
0800tulips or its contractors or employees agree to perform the work specified by the client in a professional manner, using care & knowledge to achieve satisfactory results.
8. Special Conditions as to Warranties
8.1.
All claims shall be notified to 0800tulips in writing within 7 days of the completion of services or materials or both to Private Bag 92600 Auckland or by email.
8.2.
No claim shall be accepted unless the customer has notified us in writing within the time specified in 8.1 and full payment made for the work carried out.
8.3.
Neither 0800tulips nor the manufacturers of raw materials shall be liable for any consequential, indirect or special damage or resultant loss as a result of any product or workmanship failure or due to the information supplied by the customer, or where the client gives certain instructions to the technicians. It is the industry standard that not all stains can be removed & the carpet surfaces cannot be restored to its original condition.
8.4.
On no account shall the liability of 0800tulips or its contractors, exceed the value of the materials and services supplied to the customer.
8.5.
The Workmanship Guarantee is automatically void if the customer or its staff member fails to carry out regular upkeep as recommended by 0800tulips or the manufacturers instruct ructions.
9. Consumer Guarantees Act
9.1.
The guarantees contained in the Consumer Guarantees Act 1993 are excluded where the customer acquires the goods or service or both from 0800tulips for the purposes of business in terms of Section 2 and 43 of that fact.
10. Liability
10.1.
The Consumer Guarantees Act 1993, the Fair Trading Act 1986 and other statues may imply warranties or conditions or impose obligations upon 0800tulips which cannot by law (or which can only to a limited extent by law) be excluded or modified. In respect of any such implied warranties, conditions or terms imposed on 0800tulips , 0800tulips liability shall where it is allowed, be excluded or if not able to be excluded only apply to the minimum extent required by the minimal statue.
10.2.
Any loss or damage of any kind for whatsoever reasons, including negligence, on no account shall the liability of 0800tulips exceed the contract price paid to 0800tulips.
10.3.
Customer shall indemnify 0800tulips against all claims and loss of any kind whatsoever however
caused or arising.
11. Miscellaneous
11.1.
0800tulips shall not be liable for delay or failure to perform its obligations if the cause of delay or failure is beyond its control.
11.2 Cancellation
The client may cancel a confirmed booking at any time provided that written notice is given 24 hours prior to the scheduled appointment.
In the event that the technician is unable to complete his/her work or gain access into the clients premises for any reason, then 0800tulips has the right to claim full price of the scheduled work. A collection cost may be added to the unpaid account. Unpaid accounts may incur penalty interest at 5% per month & compounding.
11.3
Where these terms and conditions of trade vary with the order or instructions from the customer these terms and conditions of trade shall prevail.
11.4
0800tulips reserves the right to amend or change these terms and conditions at any time.
